MariaDB Corporation Ab(有時也叫MariaDB Corporation): 是一家商業(yè)公司(stock company)，前身是SkySQL，是一家支持MariaDB，MySQL培訓、咨詢的商業(yè)公司，提供MariaDB Enterprise和MariaDB Enterprise Cluster等服務(wù)。

MariaDB Foundation: 致力于推廣、保護、改進MariaDB的代碼、社區(qū)、和相關(guān)生態(tài)系統(tǒng)。是一個非盈利組織，在特拉華州(delaware)注冊。

雖說是兩個獨立的組織，其核心都是MariaDB。現(xiàn)在MariaDB Foundation的臨時董事(Directors)是如下四人：Rasmus Johansson (chair)，Michael "Monty" Widenius，Jeremy Zawodny，Sergei Golubchik，除了Jeremy Zawodny是就職于Craigslist.com，其他人都就職于MariaDB Corporation Ab。

概述MariaDB商標協(xié)議

"MariaDB"商標完全歸MariaDB Corporation所有。MariaDB Foundation擁有其獨家商標授權(quán)，授權(quán)的商標包括："MariaDB Server"、"MariaDB Foundation"、"MariaDB.org"以及對應(yīng)的Logo。(參考：Exhibit A)

另外，很有意思，在MariaDB Corp的Knowledge Base中還有如下的Public Promise(3年前)：

大意是：MariaDB Corp要擔負起維護MariaDB的責任。如果這點沒做到，那么商標管理將自動移交給像MariaDB Foundation這樣的非盈利組織。如果，MariaDB Corp被收購，這點也同樣適用于對應(yīng)的收購者。

原文：

This policy requires MariaDB to maintain its role as active and primary developer of MariaDB. If MariaDB should fail to do so, the trademark management will automatically be assigned to a non-profit organization like the MariaDB Foundation. The same promise will trigger should MariaDB be bought and the buyer fail to maintain its role as active and primary developer of MariaDB.

這段文字不知道是否具有法律效應(yīng)，因為這段文字中，很多內(nèi)容都很模糊。

為什么商標歸屬很重要

這關(guān)系到"MariaDB"這個品牌是否可以持續(xù)的發(fā)展下去。一方面，這份協(xié)議確定了MariaDB Corp對商標的擁有權(quán)，可以依據(jù)此進行對應(yīng)的商業(yè)活動，確保公司業(yè)務(wù)的順利開展，也確保隨著MariaDB的日益流行，公司能夠從中收益("仰仗"此商標對外提供服務(wù))。更重要的是，這份協(xié)議也在法律意義上，確定了MariaDB Foundation可以自由的使用MariaDB Server等商標和logo，讓社區(qū)能夠自由發(fā)展。各取所需。

這里可以看到商業(yè)和開源的一種平衡。

MariaDB代碼歸誰所有

這里"歸誰所有"，是指版權(quán)所有者(copyright ownership)是誰。MariaDB版權(quán)所有者是The MariaDB Foundation。

那每一個Contributor提交的代碼呢？和很多開源軟件一樣，在向MariaDB提交代碼的之前，會被要求簽署一份MariaDB Contributor Agreement(MCA)，這份協(xié)議會指定MariaDB Foundation為joint ownership，并擁有幾乎所有代碼的處置權(quán)。原文：

you agree that each of us can do all things in relation to your contribution as if each of us were the sole owners, and if one of us makes a derivative work of your contribution, the one who makes the derivative work (or has it made) will be the sole owner of that derivative work;

當然，你也可以不簽署MCA，直接使用BSD協(xié)議提交你的代碼。
